Definitions
Throughout these terms, "photography" refers to all content created by RE:SHOOT, including but not limited to still images, video, drone footage, floor plans, 3D tours, virtual staging, and written copy.
A RE:SHOOT "photographer" refers to any creative professional engaged by RE:SHOOT to deliver services, including videographers, drone pilots, 3D technicians, graphic designers, and content writers.
"Client" refers to the person or entity that has engaged RE:SHOOT to provide services. "Property" refers to the real estate being photographed. "Homeowner" refers to the legal owner or occupant of the property.
"Working days" means Monday to Friday, excluding New Zealand public holidays. When we say "2 working days", a Thursday shoot might not be delivered until Monday.
Property Presentation
The client and homeowner are responsible for having the property in photo-ready condition before the RE:SHOOT photographer arrives. Our photographers shoot the property as they find it. They may make minor adjustments to improve a shot—moving a cushion, opening blinds, turning on lights—but they won't rearrange furniture, clean surfaces, or tidy the property.
If the photographer arrives and the property isn't ready to be photographed, they'll contact the client to discuss options. If the shoot needs to be rescheduled due to property condition, a $50 rescheduling fee applies.
We recommend reviewing our property preparation guide before your shoot. A well-presented home photographs better and requires less post-production work.
Access & Safety
The client must ensure the photographer can access the property at the scheduled time. If access isn't available within 15 minutes of the scheduled start time, the photographer may leave and a rescheduling fee will apply.
If the property is tenanted, the client is responsible for notifying occupants and ensuring they're comfortable with the shoot taking place. RE:SHOOT won't photograph occupied bedrooms or personal spaces without the occupant's consent.
Pets should be secured or removed from the property during the shoot. The photographer isn't responsible for managing animals and may decline to enter areas where unsecured pets are present.
If the photographer identifies any safety hazards—structural issues, exposed wiring, aggressive animals, or any situation that puts them at risk—they may leave the property immediately. In these cases, the shoot will be rescheduled at no fault of RE:SHOOT.
Shot Requests
Our photographers follow RE:SHOOT's standard shooting methodology, which is designed to showcase properties effectively. They'll capture the key rooms and features based on their training and experience.
If you need specific shots—a particular angle, a detail shot of a feature, or coverage of something unusual—let the photographer know before or during the shoot. You can email or text ahead, or mention it on-site.
Requests need to be reasonable given the package you've booked and the time allocated. Your photographer will do their best to accommodate requests, but they need to balance these against covering the whole property properly.
If a specific shot wasn't requested and wasn't captured, RE:SHOOT isn't liable for a free reshoot. See our reshoot policy below.
Drone & Aerial Services
All RE:SHOOT drone pilots hold current CAA certifications and operate within New Zealand aviation regulations. Some locations have flight restrictions that prevent drone photography—this includes areas near airports, helipads, and certain controlled airspace.
If drone photography isn't possible due to airspace restrictions, we'll let you know as soon as we're aware. If restrictions only become apparent on-site, we'll adjust the package accordingly.
Drone flights require suitable weather conditions. High winds (generally above 35km/h), rain, or poor visibility may prevent aerial photography. If conditions aren't suitable on the day, we'll either reschedule the drone component or substitute with alternative coverage where possible.
The client must have permission from the property owner for drone photography, particularly for footage that captures neighbouring properties.
Twilight Photography
Twilight shoots are time-sensitive—there's roughly a 20-30 minute window where conditions are ideal. The photographer will arrive with enough time to set up before this window.
If weather conditions (heavy cloud, rain, fog) prevent a successful twilight shoot, we'll work with you to reschedule at no additional cost. However, if the shoot is cancelled due to property access issues or the property not being ready, standard rescheduling fees apply.
All exterior and interior lights should be on for twilight photography. The client or homeowner should ensure lights are working and accessible before the photographer arrives.
Editing & Post-Production
All RE:SHOOT packages include standard editing: colour correction, exposure balancing, vertical straightening, and sky replacement where needed. This is included in the package price.
Additional editing—removing objects, virtual staging, adding elements—is charged separately. We won't misrepresent a property. If a potential buyer visited and couldn't reasonably expect to see what's in the photo, we won't do it.
What we will do:
- • Remove temporary items (bins, cars, hoses)
- • Blur faces in photo frames
- • Add fire to an empty fireplace
- • Declutter surfaces
- • Virtual staging of empty rooms
- • Minor blemish removal
What we won't do:
- • Change the colour of the property
- • Hide damage or defects
- • Add grass where there's dirt (without disclosure)
- • Remove permanent fixtures
- • Alter room sizes or proportions
Additional editing is charged at $100 per hour, with a minimum of 15 minutes per image. Typical times:
- Virtual staging~1 hour per room
- Object removal~30 minutes
- Grass enhancement~30 minutes
- Frame blurring~15 minutes
- Fireplace fire~15 minutes
We'll only take on editing requests we consider reasonable. If we think a request crosses into misrepresentation, we'll decline.
Virtual Staging
Virtually staged images must be clearly labelled when used in marketing materials. Most real estate platforms require this, and it's good practice regardless. RE:SHOOT will provide both staged and unstaged versions of any virtually staged images.
The client is responsible for ensuring virtually staged images are properly disclosed in listings. RE:SHOOT isn't liable for any claims arising from undisclosed virtual staging.
Revisions
All packages include one round of revisions at no extra cost, requested within 14 days of delivery. This covers:
- • Editing adjustments (colour tweaks, crop changes, minor retouching)
- • Swapping selections (different shots from what we delivered)
- • Up to 2 additional photos from captures we have on file
Beyond the 2 included extras, additional photos are $10 each. These come from existing captures and are edited to the same standard—this isn't a reshoot.
Requests outside the 14-day window or additional revision rounds may incur charges.
Reshoots
Reshoots are rare, but when they happen, we handle them based on the cause:
If it's on us:
If the reshoot is needed because of something RE:SHOOT got wrong—missed shots, equipment failure, not following reasonable requests, or work that doesn't meet our usual standard—we'll reshoot at no charge beyond travel costs.
If it's not on us:
If the reshoot is needed for reasons outside our control—the property wasn't ready, excessive clutter, the shoot was cut short for safety reasons, or the client simply isn't happy with photos that meet our standard—we'll reshoot at half the original package price, plus travel costs.
Reshoot requests must be made within 14 days of the original delivery. After that, it's a new booking at the standard rate.
If you're not happy with the photos and don't want a reshoot, we can terminate the engagement and provide a full refund. In this case, you can't use any of the content we created—it remains RE:SHOOT property. If we find our content being used after a refund, we'll take appropriate action.
Cancellations & Rescheduling
We need at least 24 hours notice to cancel or reschedule. This lets us offer the slot to someone else and means our photographer isn't left with a gap in their day.
Late cancellations (less than 24 hours notice) incur a $100 fee. No-shows are treated the same as late cancellations—if our photographer arrives and can't access the property or complete the shoot through no fault of their own, the fee applies.
Weather is the one exception. If conditions aren't suitable (heavy rain, extreme wind, hail), we'll reschedule at no cost. Light rain is usually fine if timed right—our photographers can make a call on the day. We'll always try to get the shot if it's safe and the results will be good.
Turnaround Times
Standard turnaround times from the date of your shoot:
- Photography, Drone, Floor Plans, 3D Tours2 working days
- Video / Film4 working days
We often deliver earlier, but these are the times we commit to. A Thursday morning shoot might not arrive until Monday—plan accordingly if you have a deadline.
Rush delivery: Need it faster? Same-day or next-day delivery is available for most packages at an additional fee. Let us know when booking and we'll confirm availability.
If we miss a deadline: If RE:SHOOT fails to deliver within the agreed timeframe (and you haven't requested additional work mid-process), we'll apply a 10% discount to your invoice for every working day we're late, up to a maximum of 50%. This doesn't apply to delays caused by weather, access issues, or waiting on client feedback.
Deliverables
Photos are delivered as high-resolution JPEGs, suitable for print and web use. We provide both full-resolution and web-optimised versions.
Video is delivered as MP4 files in the resolution specified in your package (typically 1080p or 4K).
Floor plans are delivered as JPEGs and PDFs. 3D tours are hosted and delivered as shareable links.
All content is delivered via our online gallery. You'll receive a link to download your files. We recommend downloading and backing up your content promptly.
File Storage
We keep your files for 12 months from the delivery date. After that, files may be archived or deleted. If you need files re-sent within the 12-month period, just ask—there's no charge.
If you need files retrieved after 12 months, we'll do our best to help, but we can't guarantee availability. A $50 retrieval fee applies for archived files.
RAW Files
We don't release RAW files. Ever. The RAW captures are RE:SHOOT property and part of our editing workflow. What you receive are the finished, edited images—which is what you're paying for.
Ownership & Usage Rights
All content created by RE:SHOOT remains the property of RE:SHOOT. When you pay for a package, you're purchasing a perpetual license to use that content for marketing that specific property—the license lasts as long as you're marketing that property.
Your license covers:
- • Online property listings (Trade Me, realestate.co.nz, etc.)
- • MLS / multi-listing services
- • Social media marketing
- • Print advertising and brochures
- • Signboards and window displays
Your license doesn't extend to third parties. Architects, builders, stagers, designers, and property owners can't use the content without separate permission from RE:SHOOT. If the homeowner wants to keep photos after the sale, they need to purchase a license from us.
A note on vendors: We know vendors often cover marketing costs, but the license is with you, the agent—not with them. Please don't pass the files on to your vendor, even if they ask. If they'd like their own copy to keep after the sale, we're happy to sort out a license directly with them.
Third-party licensing: If another agent wants to use content from a shoot they didn't book (e.g., a different agent takes over the listing), they can purchase a license for $100. This grants them the same usage rights as the original client for that property.
Media use (newspapers, magazines, blogs, news articles) is permitted as long as RE:SHOOT is credited as the image owner and the content isn't used to sell a product or service other than RE:SHOOT.
RE:SHOOT reserves the right to use the content for our own marketing, portfolio, training, and promotional purposes. If you need exclusivity, we can discuss this before the shoot—exclusivity agreements are available but must be in writing.
Portfolio & Marketing
By engaging RE:SHOOT, you agree that we may use the content created for your property in our portfolio, website, social media, and marketing materials. We won't include property addresses in public marketing without permission. If you'd prefer your property not be featured, let us know before the shoot.
Consents & Releases
By booking a shoot, you confirm you have the necessary rights to have the property photographed. This includes permission from the property owner if you're not the owner yourself.
If people appear in images (tenants, passersby), it's the client's responsibility to obtain any necessary releases for commercial use. Unless specifically agreed in writing beforehand, RE:SHOOT isn't responsible for obtaining model releases.
The client indemnifies RE:SHOOT against any claims, damages, or legal costs arising from failure to obtain proper consents or permissions.
Liability
RE:SHOOT takes reasonable care when working on your property, but we're not liable for:
- • Pre-existing damage or defects
- • Items moved during the shoot that aren't returned to their exact position
- • Any loss or damage arising from the content itself (including claims of misrepresentation made against the client by third parties)
- • Consequential losses, loss of profit, or loss of opportunity
If a RE:SHOOT photographer causes damage to the property through negligence, we'll address it on a case-by-case basis. Please report any concerns as soon as reasonably practicable after the shoot so we can investigate properly.
Our total liability for any claim relating to our services is limited to the amount you paid for the package in question.
Indemnification
The client agrees to indemnify RE:SHOOT against third-party claims arising from: the client's use of the content beyond the license granted; any failure to obtain necessary consents or permissions (e.g., from homeowners or tenants); or any claim that the content misrepresents the property where RE:SHOOT followed the client's specific instructions. This indemnity doesn't apply to claims arising from RE:SHOOT's own negligence or breach of these terms.
Our Team
RE:SHOOT may assign any of our trained photographers to your shoot. While we try to accommodate specific photographer requests, we can't guarantee a particular person will be available. All RE:SHOOT photographers are trained to our standards and deliver consistent quality.
Payment
All prices are inclusive of GST. Quotes are valid for 30 days from issue.
RE:SHOOT invoices after the work is completed and delivered. Standard payment terms are 14 days from invoice date unless otherwise agreed.
Late payments may incur a fee of 10% of the invoice amount, applied after the due date and again every 14 days the invoice remains unpaid.
We reserve the right to withhold delivery of content until previous invoices are paid, and to suspend services for clients with overdue accounts.
Confidentiality
RE:SHOOT keeps all client and property information confidential. We won't disclose details of your shoots, properties, or business to third parties, and we won't use confidential information shared with us for any purpose other than delivering our services.
Events Beyond Our Control
RE:SHOOT isn't liable for delays or failures caused by events beyond our reasonable control—natural disasters, pandemics, government restrictions, civil unrest, or other force majeure events. In such cases, we'll work with you to reschedule or find alternative solutions.
Disputes
If there's a problem, talk to us first. Most issues can be resolved with a conversation. If we can't sort it out directly, we'll attempt mediation before any formal proceedings.
These terms are governed by New Zealand law. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
General
Acceptance: By booking a shoot with RE:SHOOT, you confirm that you've read and agree to these terms. No signature is required—the booking itself constitutes acceptance.
Entire agreement: These terms, together with any quote or booking confirmation, form the entire agreement between you and RE:SHOOT. Any prior discussions or representations not included here don't form part of our agreement.
Severability: If any part of these terms is found to be unenforceable, the rest of the terms remain in full effect.
No waiver: If we don't enforce a right or provision in these terms on one occasion, that doesn't mean we've waived it for the future.
Assignment: RE:SHOOT may assign or transfer our rights and obligations under these terms (for example, if we sell the business). You can't assign your rights without our written consent.
Changes to These Terms
We may update these terms from time to time. The version that applies to your booking is the one in effect when you make the booking. We'll notify existing clients of significant changes.
